The Office of Prosecuting Attorney Joseph G. McCulloch announces that on August 21, 2023, Dioavian Cook, of Florissant was charged with DWI – Death of Another and two counts of DWI with Physical Injury.
Charges arose in August of 2023 when Cook was travelling in the wrong direction on Interstate 70 at speeds near 100 mph. During this time, Cook struck another vehicle, which resulted in the death of a passenger in the other vehicle. That passenger was identified as a 7-year-old child. The driver and passenger of the vehicle that was hit were also injured as a result of the crash. Two hours after the crash, a medical blood draw revealed Cook’s blood alcohol content to be approximately .20%

Cook is not currently in custody. A bond of $100,000.00 has been set. This matter is now pending before The Honorable Judge Dwayne A. Johnson.
